Hims & Hers falls after a court ruling on a drug it never sold

The ruling on a drug similar to one Hims & Hers sold dims the hope that a judge could allow the company to keep selling copycat Ozempic and Wegovy.

Hims & Hers shares fell Thursday after more news poured in continuing to drive the point home that the tele-pharmacy likely can't count on selling a significant amount of copycat Ozempic and Wegovy.

A federal judge ruled in favor of the Food and Drug Administration late Wednesday, ordering copycat pharmacies to stop selling exact versions of Zepbound and Mounjaro, popular GLP-1 weight loss drugs made by Eli LillyLLY $903.43 (-2.83%). Compounding pharmacies can only sell exact copies of a drug while it’s in a shortage.

Hims & HersHIMS $35.06 (-14.26%) has never sold compounded tirzepatide, the active ingredient in Eli Lilly's drugs. It does sell compounded semaglutide, the active ingredient in Novo Nordisk’sNVO $87.85 (-3.31%) weight loss drugs, Ozempic and Wegovy, though it said it will stop after May 2025.

That ruling was in a lawsuit filed by the Outsourcing Facilities Association, a trade association representing compounding pharmacies, which argued that the FDA's abrupt order to cease compounding tirzepatide after it was removed from the shortage list in October was "reckless and arbitrary." But the OFA has also filed a parallel lawsuit against the FDA over its removal of semaglutide from the shortage list on February 21.

Both cases are before Judge Mark T. Pittman of the U.S. District Court for the Northern District of Texas, suggesting OFA may get a similar result in the case regarding semaglutide. The ruling dims any glimmer of hope that a judge could somehow allow Hims & Hers to continue selling copycat Ozempic and Wegovy.

Hims & Hers shares have fallen more than 46% since semaglutide was taken off the shortage list. On Wednesday, the company took a hit after Novo Nordisk announced that it would offer Wegovy to uninsured patients at a discounted rate.

Hims & Hers has said its game plan moving forward is to sell Novo Nordisk’s older, less effective GLP-1 drugs and oral medications. The tele-pharmacy sells other generic drugs for erectile dysfunction, hair loss and mental health conditions.

Glidden-Ralston Superintendent Releases Statement Regarding Student Incident: "Students Are Safe And District Is Following Procedures"

Glidden-Ralston Superintendent Thomas Ridder says the school is investigating a reported incident that allegedly occurred between students last week. Ridder confirmed a “situation” that involved students in the district, but cannot provide any further information due to student privacy concerns.

Ridder says administration is aware of information that is being shared on social media and wants to clarify that the individuals involved were contacted, the incident is being investigated, and school officials are being as transparent as policy allows on issues involving students.

Carroll County Sheriff Ken Pingrey says, “We are aware of the complaint in question and are currently investigating.” Due to the ongoing nature of the inquiry, he could not provide further information. Ridder says safety is a main priority at Glidden-Ralston and reassures parents there is no need to worry about their students.

💰️ The Community Foundation of Carroll County (CFCC) has announced the recipients for 28 grants in the 2025 grant cycle, totaling just over $203,000 to local nonprofits and cities. The funding comes from the County Endowment program, the CFCC Endowment Fund, and the Grow Greene County Gaming Corporation. Some of the larger awards include $21,500 to the City of Lidderdale for the Lidderdale Park Project, $20,000 to the New Hope Foundation to implement smart home technology for clients, $15,000 to the Manning Betterment Foundation for crossing improvements to the Main Street and Highway 141 intersection, and $10,000 to the Breda Daycare center to incorporate infant classrooms and outdoor play spaces. Since its founding in 2006, the CFCC has distributed more than $2.4 million to benefit Carroll County organizations. The CFCC funds projects with gaming tax revenue distributed by the State of Iowa County Endowment Fund Program and gaming profits shared by Wild Rose Casino through the Grow Greene County Gaming Corporation. 🎯 Manning has surpassed $10 million in private investment through its participation in the Main Street Iowa program, the Iowa Economic Development Authority (IEDA) announced Wednesday. The milestone was recognized alongside six other Main Street Iowa communities that collectively reached $100 million in private investment for commercial district rehabilitation and property acquisition in 2024. IEDA Director Debi Durham says, “Main Street Iowa communities continue to show incredible progress in preserving and enhancing their unique character. These achievements reflect the power of collaboration, and the vision of community leaders who strive to create thriving, welcoming spaces for residents and visitors alike.” Manning was recognized alongside Albia, Colfax, Grundy Center, Marion, Monticello, and Newton at a Main Street Iowa workshop in Jefferson on Wednesday. Since 1985, Main Street Iowa programs have generated nearly $2.9 billion in private investment, leading to more than 5,600 new or expanded businesses and over 17,000 jobs across participating communities.

🏫 Voters have approved of the Glidden-Ralston Community School District (CSD) implementing a new Physical Plant and Equipment Levy (PPEL) during last night’s (Tuesday) special election. According to unofficial results from the Carroll County Auditor’s Office, the measure passed with 71.58 percent of the 292 ballots casted in favor to add a $1.34 per $1,000 of taxable valuation levy. The PPEL is expected to generate $2.2 million over the next ten years. Superintendent Thomas Ridder is thankful to those who came out to vote, supporting the levy, for much needed updates to the nearly 100-year-old building. Ridder says the funding will be used to finance debt that is incurred for many project updates throughout the school. Ridder says he has already contacted the architect firm, letting them know the district is ready to move forward with the plans. Work on the projects will begin as soon school gets out for the 2024-25 year. Ridder says GTE Construction will then get to have access to the building without students and staff to work around. Ridder says the renovations should be completed over the summer and ready for the building to be fully operational at the start of the 2025-26 school year.

New Des Moines charter school is accepting students

Des Moines Prep, a new charter high school, is set to open this fall at the former Two Rivers Marketing location.

Why it matters: The East Village school will be among a growing number of alternatives to traditional public schools in the state, though critics say they divert public funds away from school districts.

Flashback: Charter schools, which are tuition-free, have grown in Iowa since a 2021 law loosened restrictions to open them.

Driving the news: Des Moines Prep will open with 150 ninth grade students and expand each year until it serves all high school grades, says Matt Lakis, the school's principal.

  • Opportunity Education, a nonprofit out of Omaha, Nebraska, is behind the charter school. The group operates schools in Nebraska and California and plans to open charter schools in Cedar Rapids and Davenport.

Zoom in: Des Moines Prep guarantees each student will participate in career-preparation programs and graduate with at least two college acceptance letters, Lakis says.
